Terms of Service

You must be at least 18 years old and legally able to enter a contract to use the Service. By creating an account, selecting an acceptance control, or using the Service, you agree to these Terms and acknowledge the Privacy Policy at https://fluentext.com/privacy. If you do not agree, do not use the Service.

You sign in using a United States phone number and an SMS verification code. You are responsible for controlling access to your phone, browser, and account and for promptly notifying us at [email protected] if you suspect unauthorized use. Do not impersonate another person, create an account using a number you are not authorized to use, or attempt to bypass authentication, quotas, or security controls.

FluenText provides person-to-person and group chat together with AI-assisted grammar, translation, vocabulary, coach, draft, and simulated-conversation features. Because these AI features are integrated into the Service, authenticated use requires the separate Google Gemini permission described below. Features, limits, supported languages, and availability may change. AI output can be inaccurate, incomplete, offensive, or unsuitable. It is educational assistance, not professional, legal, medical, financial, or other expert advice. You are responsible for reviewing AI output and deciding whether to rely on it.

FluenText's AI features use Google LLC's Gemini paid API. Before any FluenText AI feature sends data to Gemini, you must separately allow the current Google Gemini disclosure. The consent screen identifies Google LLC, the data sent, and the purposes.

Depending on the feature, FluenText may send message or draft text; a selected word and its surrounding message; native and target languages; coach strictness or skill settings; up to 10 recent thread messages with sender labels for coach or companion context; or private-coach input with up to 10 private turns and the last 5 public messages. We do not intentionally attach your phone number or Firebase user ID to Gemini requests, but text and sender labels may contain personal or sensitive information entered by you or others.

Google processes this data to return grammar corrections, translations, definitions, or coach and companion responses. FluenText uses paid-service Gemini settings and has voluntary model-improvement log sharing disabled. Google's processing is also governed by its applicable terms and privacy commitments.

You may withdraw consent in Settings. Withdrawal stops Gemini requests that have not yet been dispatched and signs you out; a request already in flight at the time of withdrawal may complete and cannot be recalled. You must consent again to resume authenticated use. Declining consent signs you out. Account deletion remains available from the consent screen. Consent does not authorize you to submit another person's information unlawfully.

"Your Content" means messages, drafts, profile information, feedback, reports, and other material you submit. You retain any rights you have in Your Content. You grant FluenText a nonexclusive, worldwide, royalty-free license to host, copy, transmit, format, analyze, and otherwise process Your Content only as reasonably necessary to operate, secure, moderate, improve, and support the Service, including the AI processing described above. This license ends when the content is deleted from our systems, except to the extent a copy is retained as described in the Privacy Policy or by another user.

You represent that you have the rights and permissions needed to submit Your Content and permit this processing. Do not place confidential information in a chat unless you are comfortable sharing it with the intended recipients and, after consent, with Google for the disclosed AI purpose.

You may not use the Service to:

• threaten, harass, exploit, abuse, stalk, or impersonate anyone;
• distribute unlawful, defamatory, hateful, sexually exploitative, or privacy-invasive material;
• infringe intellectual property, publicity, privacy, or other rights;
• send spam, malware, fraudulent content, or unauthorized advertising;
• collect or expose another person's phone number or other data without authorization;
• probe, disrupt, reverse engineer, scrape, automate access to, or evade protections of the Service except where applicable law permits; or
• use AI output or the Service for unlawful or harmful activity.

We may investigate reports and remove content, limit features, block interactions, suspend accounts, preserve evidence, or notify authorities when reasonably necessary to protect users, operate the Service, or comply with law. We do not promise a specific review time.

Messages are shared with their recipients. Blocking is designed to prevent future contact, but it does not retract copies already delivered or stored on another person's device. Reporting tools may send the reported message and related context to FluenText for review. Group content may remain available to other members after you leave or delete your account.

FluenText may offer an automatically renewing subscription titled FluenText Pro Monthly with a one-month billing period. The current United States price is displayed in the App Store before purchase and may change; the App Store display controls if it differs from these Terms. Apple processes payment and manages billing. The subscription renews automatically unless canceled at least 24 hours before the end of the current period, and Apple may charge the renewal within 24 hours before that period ends. You can manage or cancel through your Apple account settings; deleting FluenText or your account does not itself cancel an Apple subscription. Apple's terms and refund rules apply.

Subscription access may take time to update after cancellation, refund, expiration, or billing failure.

You may request deletion in Settings or from the consent gate. Deletion is intended to remove your FluenText authentication record, profile, phone lookup, personal usage and statistics nodes, and active 1:1 or private-coach cloud chats. It does not necessarily erase content already delivered to another user's local device, shared group history needed by remaining members, reports or feedback retained for safety or support, data Apple or Google keeps under its own obligations, or AI cache entries that are not keyed by account before their scheduled expiration. See the Privacy Policy for details. Deletion is irreversible and does not cancel an Apple subscription.

The Service, excluding Your Content, is owned by Shawn Fenerin or the applicable licensors and is protected by law. Subject to these Terms, FluenText gives you a limited, personal, nonexclusive, nontransferable, revocable right to use the Service in the United States for its intended purpose. No other rights are granted.

The Service depends on services provided by Google and Apple. Their products and terms are separate from ours. We are not responsible for third-party services to the extent permitted by law, and their availability may affect FluenText.

THE SERVICE AND AI OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUENTEXT DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE.

Some jurisdictions do not allow certain disclaimers, so they may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHAWN FENERIN AND FLUENTEXT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, GOODWILL, OR BUSINESS, ARISING FROM THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID FLUENTEXT THROUGH THE APP STORE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limits do not apply where prohibited or to liability that cannot lawfully be limited.

To the extent permitted by law, you will defend, indemnify, and hold harmless Shawn Fenerin and FluenText from third-party claims, damages, and reasonable costs arising from your unlawful use of the Service, Your Content, or your material breach of these Terms. This section does not require indemnity for our own wrongful conduct.

You may stop using the Service at any time. We may suspend or terminate access when we reasonably believe you violated these Terms, created risk or legal exposure, or when needed to protect or discontinue the Service. Provisions that by their nature should survive will survive, including ownership, disclaimers, liability limits, and dispute terms.

We may update these Terms. We will post the revised Terms with a new effective date and provide additional notice when required. If a material change requires renewed agreement, continued access may be gated until you accept it. Your continued use after an effective update constitutes acceptance where permitted by law.

These Terms are governed by the laws that apply to Shawn Fenerin's operation of FluenText, without regard to conflict-of-law rules. Mandatory consumer protections in your state remain unaffected. Any dispute not resolved informally may be brought in a court with lawful jurisdiction and venue. Before filing a claim, please email [email protected] and allow a reasonable opportunity to resolve it.

If a provision is unenforceable, it will be modified only as necessary or severed, and the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, sale, or transfer of the Service. These Terms and the Privacy Policy are the entire agreement about the Service, except for terms shown for a specific purchase.
